		<description>I would contend that the difference in product is irrelevant.  If I want to make a brand of cat litter and call it Windows Vista, I doubt that would go unnoticed.  Defending the brand name is a vital part of intellectual property, regardless of the previous product&#039;s lack of success.</description>
